End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you and Leonardo Bastianon ("the Company"), Via dei Tigli, 31030 Castelcucco (TV), Italy, governing your use of the ember application (the "Application"). By downloading or using the Application, you agree to this Agreement.

1. The Application

The Application, ember, was created to help users overcome task initiation by breaking overwhelming tasks into small, manageable first actions using AI. Its main use is personal productivity and mental wellbeing — helping users start tasks, focus, and journal their thoughts with AI guidance.

2. License Grant

You are granted a non-transferable, non-exclusive, non-sublicensable license to install and use the Application on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service, except where the Application may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

This license governs any updates provided by the Company that replace, repair, or supplement the Application, unless a separate license accompanies such an update.

3. Usage Rules

• You may not share or make the Application available to third parties (unless permitted by Apple's terms and with our prior written consent), sell, rent, lend, lease, or redistribute it.
• You may not reverse engineer, translate, disassemble, decompile, modify, adapt, create derivative works of, or attempt to derive the source code of the Application.
• You may not copy or alter the Application except as permitted by this license. You may store backup copies only on devices you own or control.
• You may not remove any intellectual property notices.
• Violations of these Usage Rules, including attempts, may be subject to prosecution and damages.
• You must comply with all applicable third-party terms when using the Application.

4. User-Generated Content

You may create content within the Application, including journal entries. You are responsible for the content you create, and you retain ownership of it.

5. Technical Requirements

The Application requires iOS firmware version 16.0 or higher. We recommend using the latest version. It is your responsibility to ensure your device meets these requirements. We may update the Application to comply with new firmware or hardware, and we may modify the technical specifications at any time.

6. Liability

The Company's liability in the case of a violation of obligations and tort is limited to intent and gross negligence. In the case of a breach of essential contractual duties, the Company is also liable for slight negligence, but liability is limited to foreseeable, contractually typical damages. This limitation does not apply to injuries to life, limb, or health. The Company is not responsible for damage caused by a breach of the Scope of License. To avoid data loss, you should use the backup functions available to the extent permitted by applicable third-party terms.

7. Warranty

Defects in the Application will be remedied only if you notify the Company via email at support.ember.app@gmail.com within fourteen (14) days of discovering the defect.
