These Terms and Conditions ("Terms") govern your use of the ember mobile application (the "App"), operated by Leonardo Bastianon ("we", "us", or "our"), Via dei Tigli, 31030 Castelcucco (TV), Italy. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement.
ember is a personal productivity and wellbeing application that helps users start tasks by breaking them into small actions, provides focus sessions, and offers an AI-assisted journal. The App is for your personal, non-commercial use.
To use certain features you must create an account using Apple, Google, or email sign-in. You are responsible for maintaining the confidentiality of your account and for all activity under it.
The App offers a free tier and a paid "Pro" subscription, billed monthly or annually through Apple In-App Purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple account settings. Promotional offers (such as launch pricing) apply only as described at the time of purchase.
You retain ownership of the content you create in the App (such as journal entries). You are solely responsible for your content. By submitting content, you grant us a limited license to process it solely to provide the App's features, including processing by our AI provider.

The App, including its design, branding, and software, is owned by us and protected by intellectual property laws. If you believe content in the App infringes your copyright, please notify us at support.ember.app@gmail.com with details of the alleged infringement, and we will respond appropriately.
The App relies on third-party services (including Anthropic, Supabase, Apple, Google, and RevenueCat). Your use of the App is also subject to those third parties' applicable terms.
The App is provided "as is" and "as available." ember is a productivity and wellbeing tool and does not provide medical, psychological, or professional advice. We make no warranties regarding the App's accuracy, reliability, or fitness for a particular purpose.
To the maximum extent permitted by law, our total liability for any claim arising from your use of the App is limited to the amount you paid us in the six (6) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
In the event of a dispute, you and we agree to first attempt to resolve the matter through informal negotiations for at least thirty (30) days. If unresolved, the dispute will be settled by arbitration in Treviso, Italy, conducted in Italian.
We may update these Terms from time to time. We will update the "Last updated" date and notify you by email of material changes.
